You guys over think everything! When there is a question ...apply common sense as trump. As already stated by Alan and I concur.

-Rule 5.6 is clear.
-AND reality is clear. A loaded transport is NO different in taking up space as an unloaded transport. If the loaded unit is forced to disembark in a maxed' out hex, it is penalized. Seems cut and dry. Now get rolling!
